ARTICLE 5 AVIATION SECURITY
1. Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on offences and certain other Acts Committed on Board Aircraft signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971, its Supplementary Protocol for the suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988.
2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Contraction Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as annexes to the convention on International Civil Aviation to the extent that such security provisions are applicable to the Contracting Parties; they shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their territories and the operators of airports in their territories act in conformity with such aviation security provisions.
4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party for entry into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft sores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safety such incident or threat thereof.

ARTICLE 6 DESIGNATION AND OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to designate one airline for the purpose of operating the agreed services. Such designation shall be effected by virtue of a written notification between the aeronautical authorities of both Contracting Parties.
2. The aeronautical authorities which have received the notification of designation shall, subject to the provisions of paragraphs 3 and 4 of this Article, grant without delay to the designated airlines of the other Contracting Party the necessary operating authorization.
3. The aeronautical authorities of on Contracting Party may require the airline designated by the other Contracting Party to prove that it is qualified to fulfil the conditions prescribed under the laws and regulations normally applied to the operation of international air services by the said authorities in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to accept the designation of an airline and to refuse to grant the operating authorization referred to in paragraph 1 and 2 of this Article, or to impose such conditions as it may deem necessary for the exercise of the rights specified in Article 2 of the present Agreement, whenever the said Contracting Party has no proof that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals.
5. Having received the operating authorization, provided for under paragraph 2 of this Article, the designated airline may at any time start to operate the agreed services, provided that tariffs established in accordance with the provisions of Article 14 of the present Agreement are in force.

ARTICLE 7 REVOCATION AND SUSPENSION OF OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article 2 of the present Agreement by the designated airline of the other Contracting Party or to impose such conditions as it may deem necessary on the exercise of such right, if:
(a) the said airline cannot prove that substantial ownership and effective control are vested in the Contracting Party designating the airline or in its nationals, or
(b) the said airline fails to comply with or has infringed the laws or regulations of the Contracting Party granting these rights, or
(c) the said airline fails to operate the agreed services in accordance with the conditions prescribed under the present Agreement.
2. Such a right shall be exercised only after consultation with the other Contracting Party, unless immediate revocation, suspension or imposition of the conditions provided for under paragraph 1 of this Article is essential to prevent further infringements of laws and regulations.

第5条 航空安全
1、与国际法项下的权利和义务相一致,缔约双方重申,为了保护民用航空安全不受非法干扰行为的威胁而相互承担的义务构成本协定不可分割的一部分。在不限制国际法项下双方权利和义务普遍性的情况下,缔约双方应当特别遵守1963年9月14日在东京签订的《关于在航空器内犯罪和其他某些行为的公约》、1970年12月16日在海牙签订的《关于制止非法劫持航空器的公约》、1971年9月23日在蒙特利尔签订的《关于制止危害民用航空安全的非法行为的公约》以及1988年2月24日在蒙特利尔签订的《关于制止在用于国际民用航空的机场发生的非法暴力行为的补充议定书》。
2、为了防止非法劫持航空器的行为和损害航空器、旅客和机组人员、机场、导航设备安全的其他非法行为,以及为了防止民用航空安全受到任何其他威胁,缔约双方在另一方提出请求时应相互提供所有必要的协助。
3、在双边关系中,只要国际民用航空组织制定并指定为国际民用航空公约附件的航空安全规定适用于缔约双方,则双方应当遵循该安全规定。缔约双方应当要求其登记航空器中的操作人员、或主要营业地点或永久居住地点在其领土内的航空器中的操作人员、以及在其领土内的机场的操作人员遵循该安全规定。
4、缔约各方同意,缔约一方可能可以要求航空器的操作人员在进出或停留该缔约方领土内时遵循上述第3段所指的航空安全规定。缔约各方应确保在其领土内采取充分而高效的措施,以保护航空器并在登机或装载之前和之中查验旅客、机组人员、随身物品、行李、货物和航空器补给品。如果缔约一方要求为其采取特殊安全保卫措施以对付某一威胁,缔约另一方对此也应给予同情的考虑。
5、当发生非法劫持航空器或损害航空器、旅客和机组人员、机场、导航设备安全的其他非法行为的事件或威胁时,缔约双方应相互协助,提供联系的便利并采取适当的措施,使这种事件或威胁迅速而安全地结束。

第6条 指定和经营许可
1、缔约各方有权指定一家经营协议航空服务的航空公司。该项指定依据缔约双方航空当局之间的书面通知而生效。
2、在满足本条第3段和第4段规定的前提下,缔约一方航空当局在收到上述指定后,应毫不延误地给予缔约另一方指定航空公司以必要的经营许可。
3、缔约一方航空当局可以要求缔约另一方指定航空公司向它证明,该航空公司有资格履行根据法律和规章所制定的条件,这些法律和规章是上述当局在经营国际航空服务方面通常实施的,并符合公约的规定。
4、一旦缔约一方无法证明指定航空公司的主要所有权和有效管理权属于缔约方或其国民,则缔约另一方有权拒绝接受对该航空公司的指定,并有权拒绝给予本条第1段和第2段所指的经营许可,或者对行使本协定第2条的权利规定它认为必要的条件。
5、指定航空公司按照上述第2段获得经营许可后,只要根据本协定第14条规定制定的运价已经生效,即可随时开始经营协议航空服务。

第7条 经营许可的取消和暂停
1、在下列任一情况下,缔约一方有权取消业已给予缔约另一方指定航空公司的经营许可,或暂停该指定航空公司行使本协定第2条规定的权利,或对行使这些权利规定它认为必要的条件:
(a) 该航空公司不能证明其主要所有权和有效管理权是属于指定该航空公司的缔约方或其国民;或
(b) 该航空公司未能遵守或已经违反给予其权利的缔约方的法律或规章;或
(c) 该航空公司没有按照本协定规定的条件经营协议航空服务。
2、除非本条第一款所述的取消、暂停或规定条件必须立即执行,以防止进一步违反法律和规章,否则这种权利只能在与缔约另一方协商后方可行使。
